Terms and Conditions

Welcome to BSM Traders. These Terms and Conditions govern your use of our website and the purchase of products from us. By placing an order with us, you agree to be bound by these terms. This site is for business customers only.

1. General

This website and all transactions are strictly for wholesale and B2B (Business-to-Business) purposes. We do not sell to individual consumers. You must be a registered business to create an account and place an order.

2. Pricing and Payments

All prices listed are wholesale prices and include Goods and Services Tax (GST) or other applicable taxes, which will be added at checkout. We accept payments via the methods specified on our site. Payment is due upon placing your order unless other credit terms have been agreed upon in writing. We reserve the right to change our prices at any time.

3. Orders

We may require a Minimum Order Quantity (MOQ) or minimum order value for certain products or for each order. Any such requirements will be clearly stated on the product page or at checkout. We reserve the right to refuse or cancel any order at our discretion, including if we suspect it is not a legitimate B2B transaction.

4. Shipping and Delivery

You are responsible for all shipping costs unless otherwise specified. Once the products leave our warehouse, the risk of loss or damage passes to you. We will not be liable for any delays in delivery caused by our third-party carriers or by events beyond our control.

5. Returns and Claims

All sales are final. We do not accept returns for change of mind. If you receive products that are damaged or incorrect, you must notify us within 7 business days of delivery. You can do this by sending an email with your order number and photos of the issue. We will work with you to find a resolution, such as a replacement, credit, or refund for the damaged items.

6. Product Liability

As a distributor, we sell products on an "as is" basis. While we strive to ensure product quality, we are not the manufacturer. Our liability is limited to the value of the products purchased. We are not liable for any indirect, special, or consequential damages arising from the use or inability to use the products. It is your responsibility to ensure the products are suitable for your business and comply with all applicable laws and regulations, especially for regulated goods like alcohol or tobacco.

7. Your Responsibility

You agree to comply with all federal, state, and local laws regarding the purchase and resale of our products. This includes, but is not limited to, obtaining and maintaining any necessary business licenses, permits, or certifications, such as a liquor license for selling alcoholic beverages.

8. Governing Law

These terms and conditions are governed by the laws of Auckland, New Zealand.
